This website is operated by Bridging Healthcare. Throughout the site, the terms “we”, “us” and “our” refer to Bridging Healthcare. Bridging Healthcare offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Stripe Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence, or that you are the age of majority in your state or territory of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Communications
Bridging Healthcare uses a reminder system to help you maintain your health. The clinic sends reminder by email, post or SMS for appointments, vaccinations, and other required health reviews. By booking an appointment with us you are consenting to being contacted for reminders relating to health planning and management.

When you book an appointment with Bridging Healthcare, you are providing consent for your de-identified health information to be shared for the purposes of service improvement and research activities that provide insight into and improve community health and health services management.

Section 3 - Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Section 6 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Your submission of personal information through the store is governed by our Privacy Policy. Bridging Healthcare is committed to protecting your privacy, and respects and upholds your rights to privacy protection under applicable privacy laws. Bridging Healthcare complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, as well as all other applicable legislation including State and Territory health records legislation, when dealing with personal information.

Personal information is any information or an opinion (whether true or not and in any form) about an identified individual, or an individual who is reasonably identifiable.

Sensitive information is a subset of personal information and includes information or an opinion about:

  1. an individual's racial or ethnic origin;

  2. membership of a professional or trade association;

  3. sexual orientation or practices;

  4. criminal record;

  5. health information;

  6. genetic information;

  7. biometric information and templates.

Health information is a broad category of sensitive information about the health or a disability (at any time) of an individual or their expressed wishes about the future provision of health services to him or her or a health service provided, or to be provided, to them.

Bridging Healthcare is committed to ensuring all of your personal information is afforded the highest level of protection and so for the purpose of this Privacy Policy and our privacy practices, no distinction has been made between the handling of personal information and sensitive information (including health information). Therefore, all information will be referred to as ‘personal information’ throughout this document and offered the same higher level of protection that sensitive information and health information is afforded under relevant privacy laws.

The types of personal information that we collect from you will depend on your relationship with us, the nature of the service we are providing or activity you are involved in and the legal obligations we may have.

Patients

Examples of personal information which we may collect from patients of our clinic includes, but is not limited to:

  • your name, postal address, delivery and collection addresses, phone number and e-mail address

  • demographic information including profession, gender, age and date of birth

  • health information about patients, including medical and family history, medications, diagnostic imaging and reports, pathology results, diagnoses (including mental health or disability), observations and reported symptoms

  • financial details and billing information including your credit card details, Medicare number and health fund details

  • details of any other health services or providers which you see or to which you are referred.

Prospective employees and Partners

In order to assess applications for employment or engagement with Bridging Healthcare we collect the following information about you:

  • contact details including address, postcode, telephone and fax numbers, email addresses;

  • demographic information, including age, date of birth, and gender;

  • qualifications and experience; and

  • information contained in references obtained from third parties.

We only collect personal information by lawful and fair means as reasonably necessary for one of our functions or activities, to meet our legal obligations, or otherwise in accordance with any specific consent given by you.

How we collect your personal information:

Directly from you

We will endeavour to collect personal information directly from you or with your consent. We collect personal information about you in a number of ways, including but not limited to:

  • when you provide us with information in person, electronically or over the telephone;

  • if you complete relevant forms, surveys, questionnaires or you otherwise contact or communicate with Bridging Healthcare;

  • if you are providing services to Bridging Healthcare or its patients; or

  • if you apply for employment or engaged with Bridging Healthcare.

From someone else

Where it is unreasonable or impracticable to collect information directly from you, we may obtain personal information about you from a third party. For example, Bridging Healthcare may collect personal information about you from:

  • other health service providers;

  • relatives, friends or carers;

  • publicly available sources of information;

  • from third parties such as Medicare, DVA, your health fund, credit reporting bodies and marketing agencies, including information you may provide to us using our social media pages,

  • referees identified in your application for employment or Partnership; and

  • from our own records.

From our website

Like many companies, we sometimes uses "cookie" technology on our website and other online mediums. A “cookie” is a small summary file containing a unique ID number which is stored on your computer by your browser. When you log in, the cookie tells Bridging Healthcare whether you've visited the website before or if you are a new visitor. The cookie doesn't obtain any personal information about you or provide us with any way to contact you, and the cookie doesn't extract any information from your computer. Bridging Healthcare uses the cookie to help it identify the relevant website features in which you have the greatest interest, so that it may better personalise your access to the website and other online mediums you engage with.

If you do not wish to receive cookies, you can set your browser so that your computer does not accept them.t personal information by lawful and fair means as reasonably necessary for one of our functions or activities, to meet our legal obligations, or otherwise in accordance with any specific consent given by you.

If you are a receiving a health service from us, it is not practical for you to remain anonymous because we need to keep a record of the care and services provided to you. We may be able to accommodate you using a pseudonym, however you should be aware that should you choose not to provide your real identity this may impact the quality of the services provided to you and relevant claiming/billing. If you wish to use a pseudonym that is linked confidentially to your real identity, please let us know and we will discuss with you the arrangements that can be made for relevant care and treatment at our clinic.

Otherwise, you may contact us anonymously or by using a pseudonym if you prefer to do so. If you choose to remain anonymous this may limit our ability to assist you with any feedback or enquiry. We will tell you if we need to collect your name or any other personal information to help further.

If you do not provide us with the personal information described above, some or all of the following may happen:

  • we may not be able to provide our services, products or programs to you;

  • we may not be able to provide you with information or important updates about services, products and programs that you may want;

  • we may be unable to tailor the content of our Websites to your preferences and your experience of our Websites may not be as enjoyable or useful; or

  • we may not be able to process or progress your employment or engagement application.

We collect, hold, use and disclose your personal information so that we can perform and improve our business activities and functions as a health service provider, and to provide you with products or services which you may request.

We will use and disclose your personal information for the purpose for which it was collected, or otherwise in accordance with privacy laws or your consent. In some cases, this will include disclosure of your personal information to a person or entity outside of Bridging Healthcare.

We will take reasonable steps to ensure that these organisations are bound by privacy obligations in relation to the continuing protection of your personal information.

For patients, some disclosures that may be necessary in providing you with a health service include to:

  • Bridging Healthcare staff, agents, contractors and consultants involved in the provision of your care or administrative staff involved in the provision of services to you;

  • other health service providers involved in your care and treatment, and their staff;

  • financial institutions, Medicare, DVA or your private health insurer for the purposes of billing;

  • your authorised or responsible contact or next of kin;

  • government and regulatory authorities and other organisations, as required or authorised by law, including those operating relevant public health registers.

Secondary purposes

We will otherwise only use or disclose your personal information for another, secondary, purpose if:

  • you have consented to the use or disclosure;

  • for the general management and operation of Bridging Healthcare, for example:

    • billing/debt-recovery, service-monitoring, funding, complaint-handling, incident reporting, developing and planning services, evaluation and improvement, quality assurance or audit activities, and accreditation activities;

    • education and training of our staff (who may not be our employees), where de-identified information is not sufficient for this purpose;

    • third party service providers who provide services to Bridging Healthcare such as information technology, maintenance and repair, marketing, payment systems, etc.;

  • we reasonably believe the use or disclosure is necessary to lessen or prevent a serious and imminent threat to an individual’s life, health or safety, or a serious threat to public health or public safety;

  • the use or disclosure is required or authorised by law.

    In addition to holding your personal information in Australia we may hold your personal information in the cloud or on servers located outside of Australia. We take all reasonable steps to ensure that the personal information which has been transferred outside of Australia will be held in jurisdictions whose privacy laws are equal to or better then Australia’s, and will not be held, used or disclosed by the recipient of the information inconsistently with the Australian Privacy Principles.

We will take all reasonable steps to secure your personal information. We recognise the importance of ensuring that personal information is accurate and we will take all reasonable steps to make sure that the personal information collected, used or disclosed is complete and up to date.

Electronic information is protected by various security measures and access to information and databases is restricted to our staff and contractors that need access to the information in order to perform their duties.

Bridging Healthcare cares about protecting the security of your personal information, and we have implemented security procedures to protect the personal information which you provide to us.

Because of the sensitive nature of the information collected by Bridging Healthcare, precautions are taken to ensure the security of the information. Information may be stored electronically and / or hard copy. Security and business continuity measures like password protection and regular backups are employed to maintain privacy and availability of electronic files.

You may, at any time, request details of and access to a copy of your personal information held by us by contacting us in writing. To protect your privacy, Bridging Healthcare may require proof of your identity before acting upon your request.

In response to valid requests, we will provide you with access to your personal information unless there is a legal or administrative reason for denying or limiting access, as permitted by the Privacy Act 1988 (Cth). If we propose to deny access for any reason, we will advise you of the grounds and our reasons for any refusal.

Where we provide you with access to your personal information, we reserve the right to charge you a reasonable administrative fee for providing such access. We will not charge for simply making the request and will not charge for making any corrections to your personal information.

If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment then we will add a note to the personal information stating that you disagree with it.

From time to time, it may be necessary for us to make updates or change this privacy policy without notice. The updated privacy policy will be accessible on the website at all times.

Section 11 - Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

Section 13 - Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of telehealth services will be uninterrupted, timely, secure or error-free.

A telehealth consultation will not be exactly the same, and may not be as complete, as a face-to-face service.

  • There could be some technical problems that affect the quality of a telehealth visit.

  • Telehealth services are generally for minor illnesses, general advice, prescription refills, and diagnostic imaging or blood test request forms.

  • No prescriptions for benzodiazepines (e.g. Ativan, Valium, etc.) or narcotics (e.g. Panadeine Forte, Endone, etc.) will be issued.

  • Your privacy is important to us and any information discussed during the consultation will be private, confidential and encrypted.

Before engaging our service, please confirm you understand the limitations of a health service provided online and are happy to proceed.

  • If the telehealth visit does not achieve everything that is needed, you will be given a choice about what to do next. This could include a follow up face-to-face visit with your preferred provider, a telephone call or a second video visit.

  • You can change your mind and stop using video consultations at any time, including in the middle of a video visit. This will not make any difference to your right to ask for and receive health care.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Bridging Healthcare, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

For All Clinical Services:

Booking an appointment with this service does not guarantee the outcome requested by the health consumer. For example, if you book in a consultation for a specific medicine, diagnostic test or paperwork that your practitioner has not deemed appropriate or eligible for the service, it will not be provided. If you are unhappy with this outcome we encourage you to discuss this with the practitioner in the first instance. If you remain unsatisfied, we will be happy to refund you 50% of the consultation fee. This percentage is based upon the bilateral relationship and trust that is built between health practitioner and health consumer. A higher refund fee will be considered on an individual basis, and is health practitioner dependent.

Section 14 - Indemnification

You agree to indemnify, defend and hold harmless Bridging Healthcare and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Section 15 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 16 - Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Section 17 - Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australian Capital Territory, Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Section 20 - Return Policy (Repeat Prescription Service)

If you have a minor problem with your prescription, Bridging Healthcare will provide a replacement script free of charge. Minor problems include:

  • Incorrect strength, formulation, or frequency provided by patient.

  • Failure of prescription delivery service (e.g. eScripts).


If you have a major problem with a prescription, you have the right to ask for your choice of a replacement or refund. However, this consumer guarantee does not apply if your request is for a different medicine than originally requested, simply changed your mind, found it cheaper somewhere else, or decided you did not like the Service or had no use for it. Major problems include:

  • Pharmaceutical Benefits Scheme subsidy is available to patient if prescription written by a medical practitioner and not a nurse practitioner.

  • Prescription requested is a S8 or S4D medicine, as these are not available through the Repeat Prescription Service.
